Terms of Service

These Terms of Service ("Terms") govern your access to and use of the CinderBackup service, software, and website (collectively, the "Service") operated by Marouane El Orfi, a sole proprietor doing business as CinderBackup, located at 519 8th St, Rawlins, WY 82301, United States ("CinderBackup", "we", "us"). By creating an account or purchasing a plan, you agree to these Terms.
1. The Service
CinderBackup provides client software and cloud storage that lets you create encrypted backups of devices you own or are authorised to back up, and restore those backups on demand. Plan features and storage limits are described on the Pricing page.
2. Accounts
You must provide accurate registration information and keep your credentials secure. You are responsible for all activity under your account. We do not knowingly provide the Service to individuals under the age of 16.
3. Purchases and Billing
- All plans are sold as a one-time purchase, billed in USD. There is no recurring subscription and no auto-renewal.
- Payments are processed by Stripe Payments Europe, Ltd. We do not store full card numbers on our servers.
- Applicable VAT or sales tax is calculated and displayed at checkout.
- Each plan grants the listed features and storage capacity for the lifetime of the plan, subject to these Terms.
4. Refunds
Refunds are governed by our Refund Policy, which forms part of these Terms.
5. Acceptable Use
You agree not to use the Service to:
- Store, transmit, or distribute content that is illegal under the laws of the United States or your jurisdiction;
- Infringe intellectual property rights of any third party;
- Attempt to disrupt or compromise the security of the Service or any other user's data;
- Resell or sublicense the Service without our written consent.
6. Your Data
You retain all rights to the files you back up. We process them as a data processor on your behalf, as described in the Privacy Policy. CinderBackup uses zero-knowledge encryption: files are encrypted on your device before transmission, and we cannot access their contents.
7. Service Availability
We target 99.9% monthly availability for backup and restore endpoints but do not guarantee uninterrupted service. We may schedule maintenance windows and will provide reasonable notice for material changes.
8. Termination
We may suspend or terminate your account if you materially breach these Terms or use the Service unlawfully. You may stop using the Service and delete your account at any time.
9. Disclaimers
The Service is provided "as is" and "as available". We disclaim all implied warranties to the maximum extent permitted by law. While we operate with multiple redundancy layers, backup is a safety net — not a substitute for sound data management practices.
10. Limitation of Liability
To the maximum extent permitted by law, our aggregate liability for any claim arising from the Service is limited to the amount you paid us for the relevant plan in the twelve months preceding the event giving rise to the claim. We are not liable for indirect, incidental, or consequential damages.
11. Governing Law
These Terms are governed by the laws of the State of Wyoming, United States, without regard to its conflict-of-laws rules. Disputes will be resolved in the state or federal courts located in Wyoming, except where mandatory consumer-protection law requires otherwise.
12. Changes
We may update these Terms from time to time. Material changes will be announced by email and on this page at least 14 days before they take effect.
